General terms of use for eLearning using the geevo Cloud Academy™

The regulations below apply to all visitors and/or participants of eLearning courses using geevo cloud Academy™. The use of the eLearning platform is approved in accordance with data privacy laws.

 

Enrolment and registration

To participate in geevo Cloud Academy™ courses, users are required to submit directly or via their company representatives all necessary data, for our personnel to enrol them to the relevant course. Guests requiring access may request a guest account from trainings@geevo.eu. 

 

As part of the registration process, the following data, known as inventory data, is saved in geevo Cloud Academy™ for each participant: Username, first name and surname, email address and sometimes we may request an ID.

 

Data protection

All personal data relating to a participant collected as part of the enrolment and registration process is processed in accordance with the applicable legal data protection provisions. This also applies to individual connection data saved for the eLearning platform for which storage is required by the system, and which is subject to a time limit.

General responsibilities of the user

The registration process affords the user a simple, non-transferable right to use this eLearning platform. The storage space made available to the user may only be used for saving the content provided. All users are obliged to treat the data of other users which is accessible to them as strictly confidential and may not pass this data on to third parties without written permission from the relevant user. 

 

The eLearning platform is to be used solely for creating and conducting eLearning platform courses via geevo Cloud Academy™ and for internal communication between teachers and students. All other uses of the eLearning platform, such as for other private and/or commercial purposes, are prohibited. All users must comply with legal provisions, in particular those relating to copyright and data protection. When providing links to external websites, users must first check that these external websites do not have any illegal content.

 

As a rule, users of the learning platform must not:

·      change, delete, hide, render data unusable and/or use data for any purpose other than that intended, without permission.

·      distribute in particular materials from organisations which contradict the constitution, or their ideas.

·      post abusive, insulting, or slanderous comments about others.

·      or damage the reputation of our Company and Services.

 

The user acknowledges that:

·     The training material is property of us.

·     This training material has been prepared, maintained, updated, and distributed by us. 

·     The use of the training material on our modules is restricted to the Registered User who has been supplied with the log in details by us. 

·     The Registered User shall not copy, share, modify, transmit, distribute, or in any way, exploit the copyrighted materials provided by us, other than for their own individual training. Use for any other purpose is expressly prohibited by law and any violators will be prosecuted.  

·     The Registered User shall not permit anyone else to copy, use, modify, transmit, distribute, or in any way, exploit the copyrighted materials. 

·     The materials made available by us are provided "as-is" without warranties of any kind, either expressed, or implied, including, but not limited to, all implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. 

·     We do not warrant that the materials will be error free including technical inaccuracies, nor free of viruses, or other harmful matter. The entire cost of any necessary service, repair, or correction, is the Registered User's responsibility. 

·     We may make improvements, or changes, to this material at any time without prior notification. 

·     All rights not expressly granted herein are reserved. 

 

Exclusion of users

In the event of a serious and/or repeated breach of these terms of use, the user concerned may be excluded from using the eLearning platform either temporarily or permanently. The eLearning platform administrators are generally authorised to make decisions relating to such exclusions. Before imposing temporary or permanent exclusion on a participant, a request must be made to the participant to stop the offensive behaviour. Only if the user in question does not noticeably change their behaviour may the administration decide to exclude the user.

 

Excluded users may be re-granted access if it is ensured that the improper use will not be repeated in the future.

 

Furthermore, the administration reserves the right to delete a user from the system, following notification, if they have not accessed the eLearning platform for more than 90 days.

 

Copyrights

Documents or parts of documents protected by copyright, such as course materials, templates or extracts from other documents or images which are being used as part of the eLearning platform course and/or have been created explicitly for one course area, should not be used outside the course area and/or be passed on to third parties.

 

This applies in particular to teaching and eLearning materials created by course leaders and to contributions protected by copyright which are produced by individual participants or groups of participants as part of the eLearning platform course.

 

These documents may only be passed on to third parties and/or used outside of geevo Cloud Academy™ platform with the written permission of the copyright holder. All users expressly agree that all personal contributions produced by them, regardless of any existing copyright protection, may be used only for the purposes of the course.

 

We reserve the right to permanently delete eLearning platform courses and all content contained within the course at the earliest one year after the course has ended.

 

Disclaimers and Limitations of Liability

Users are accessing the eLearning Platform at their own risk. The Platform is provided on an "as is, as available" basis without warranty of any kind, expressed, implied or statutory, and any and all warranties of merchantability, fitness for a particular purpose or non-infringement of third parties' rights are specifically disclaimed. We do not warrant any particular result from use of the software or site. We do not warrant that the information on the site is accurate, complete or complies with any particular law or regulation, or that the operation of and your access to the site will be uninterrupted, error-free, virus-free, or completely secure.

We do not accept liability and we cannot be liable for criminal, tortious, or negligent actions or omissions of third parties that affect this site.

 

 

INDEMNIFICATION

TECHNICAL SUPPORT AND ACCESS

If you are unable to access the eLearning Platform and/or a Course, we will use reasonable endeavours to provide a solution where we have direct control over the system, software or settings involved. If the issue lies with your hardware, systems, software or settings thereof, we may, in our discretion, provide assistance to you to help you resolve the issue but we cannot guarantee that any assistance provided will resolve your issue.

You accept and acknowledge that periods of downtime may be required in respect of the information technology infrastructure connected to the eLearning Platform and that technical assistance may not be available during such periods of downtime. Further you accept that you will not have a claim for breach of contract or otherwise in respect of such period of unavailability.

We will use reasonable endeavours to make the Online Course available but cannot guarantee uninterrupted, timely or error free availability or that defects will be corrected. We reserve the right to suspend access to the Website for the purpose of scheduled or emergency maintenance, repairs or upgrades to improve the performance or
